A lawsuit filed by Second Baptist Church against the Board of Trustees of Second Baptist Church of Starkville will be heard in the Chancery Court of the Lowndes County Courthouse in Columbus at 2 p.m. Tuesday.
Judge Kenneth M. Burns will be presiding over the case.
The complaint was filed on June 26 and concerns the spending of church funds used by the Board of Trustees after filing a lawsuit without authorization of church members.
The complaint filed said church members never approved the lawsuit of the "Board of Trustees, et al. versus Miller, et al." and that members have voted to discontinue the lawsuit.
Legal counsels for both parties involved could not be reached for comment by press time on Monday.
The plaintiffs are requesting an order granting:
-An injunction prohibiting the defendants from expending any additional church monies to advance the litigation in circuit court to the extent that they purport to do so on behalf of the church.
-An accounting of all church monies spent on the unauthorized litigation.
-An accounting of all monies paid to church employees Pansy Brown and Louella Calmes and any other church funds illegally spent.
-Any and all further relief deemed necessary by this court.
